1) REGISTRATION FEE
A registration fee is applied to each apartment rental. The amount of the fee varies according to the type of accommodation. The cost of the registration fee is indicated on each apartment sheet published on our website (the payment of the deposit implies the acceptance/signing of this contract).
When booking, the Client is required to pay the travel agent a deposit equal to 25% of the total amount of the stay, in addition to additional costs (ferry, registration fee, insurance where applicable), unless otherwise stated.
The balance must be paid by bank transfer 15 days before the start of the trip/stay.
For bookings made less than 15 days from the start of the trip/stay, the Client is required to pay the full balance. In the event that the client wishes to pay the balance upon arrival, the balance can be paid in cash or by cheque. In the event of non-payment to the travel agent for the services booked within the terms indicated above, the above-mentioned shall have the right to decide, at its sole discretion, to invalidate any document/travel document previously issued and to cancel the services booked and/or proceed legally to obtain payment for the same.
If the non-refundable rate is applicable, the Client shall pay the full balance upon confirmation of the booking.
Easyelba shall send the traveller an “Option quotation” containing: detailed description of all the services offered, the price of these services, the amount of the deposit and a copy of the “General Conditions”.
The reservation shall be considered completed upon written confirmation by Easyelba to the Client of receipt of the deposit. The payment of the above-mentioned deposit automatically involves confirmation of receipt, reading and acceptance of these “General Conditions” by the Client.
4) CHANGES MADE BY THE ORGANISER
Information, descriptions, promotions, offers, seasonality and rates shown on this website are to be considered accurate, except for errors, omissions and updates. Easyelba reserves the right to communicate any changes at any time. Should force majeure be applicable, Easyelba reserves the right to replace the accommodation and/or resort. The traveller must notify Easyelba in writing of his/her decision to withdraw or use the alternative package no later than 2 days from receipt of the alternative proposal. Failure by the Client to accept any changes shall bind Easyelba solely and exclusively to the return of the sums received within 7 working days from the moment of communication by the Client.
5) CHANGES MADE BY THE CLIENT
For each single change requested by the Client after booking, the sum of 30.00 Euros for each instance plus any penalties shall be charged on a flat-rate basis.
Travellers who are unable to go on a booked trip may transfer their booking to a person who meets all the conditions required for the trip. The transferor must notify Easyelba by registered letter with return receipt, which must be received no later than 4 working days before the start of the stay, indicating the transferee’s personal details. The transferring traveller and the transferee shall be jointly responsible for payment of the price as well as for the additional costs deriving from said transfer, in the amount of 30.00 Euros.
7) WITHDRAWAL CANCELLATION
In the event of withdrawal from the travel contract, the conditions shall be applied based on the rate selected at the time of booking.
Penalties for Standard Rate cancellation:
– 25% of the cost of the stay up to 28 days from the arrival date
– 50% of the cost of the stay 27 to 15 days from the arrival date
– 75% of the cost of the stay 14 to 8 days from the arrival date
– 100% of the cost 7 days from the arrival date.

+ ferry ticket (where applicable, penalties from the shipping company)

Penalties for Relax Rate cancellation:
– For cancellation up to 28 days from the beginning of the stay:
full refund of the deposit paid and any ferry costs,

– For cancellation 27 to 15 days from the arrival date: 50% of the amount of the stay
– For cancellation 14 to 8 days from the arrival date: 75% of the amount of the stay
– For cancellation 7 days from the arrival date: 100% of the amount of the stay

8) CONDITIONS FOR APARTMENT RESERVATIONS
The property is leased as a temporary and secondary residence during the summer holiday period. The parties agree that this contract is expressly concluded for this purpose, excluding any other. The contract shall be made out exclusively to natural persons and not to VAT registered parties unless previously agreed.
Unless otherwise indicated, the prices are per apartment and for the period indicated. They include: the rental of the premises with related services, furniture, dishes and objects for the kitchen and essential accessories for a short holiday stay, VAT. The consumption of water, electricity and gas is also included.
The rates DO NOT include linen services, final cleaning, the cost of any extra beds, or the registration fee, any applicable tourist tax and anything else not expressly indicated as included or for free.
Unless otherwise indicated, the apartments shall be made available from 4.30 pm to 7 pm on the day of arrival and must be vacated by 9.30 am on the day of departure in excellent clean conditions with particular reference to the kitchen and bathrooms. Should the arrival be delayed due to force majeure, it is necessary to notify the Agency.
In no case is it permitted for the accommodation to be occupied by a number of adults and children greater than that for which the apartment was designed.
Upon arrival, a deposit for any damage must be paid to the agency unless otherwise indicated, which shall be returned at the end of the stay after checking the apartment and subject to deduction for reimbursement of damage caused or for failure to clean the cooking area or for not having properly disposed of waste during the period of stay. The amount of the deposit is indicated in each accommodation sheet.
Animals are allowed, if accepted in the relevant facility, only with express authorisation.
CONDITIONS FOR HOTEL PRICES RESERVATIONS
The prices in the tables shown on the site are per person in a double room with services on the basis of the indicated conditions, with the relative supplements and reductions (age is not relevant for added beds) and include VAT. and service percentage. The conditions chosen must be the same for all occupants of the room. Extra meals purchased individually may have a higher price and any meals not consumed shall not be refunded. The prices do not include drinks, tips, extras in general, any tourist tax and anything else not expressly indicated as included or for free.
HOTEL ROOM AVAILABILITY
Unless otherwise indicated, the rooms shall be made available from 3 pm to 7 pm on the day of arrival and must be vacated by 9 am on the day of departure. Should the arrival be delayed due to force majeure, it is necessary to notify the management of the accommodation facility.
CLASSIFICATION OF HOTEL/RESIDENCE ACCOMMODATION FACILITIESS
The classifications and categories of hotel accommodation facilities are assigned according to the regulations in force by the competent local authorities. For non-hotel accommodation facilities or in the absence of official classification, Margherita Viaggi assigns its own subjective evaluation based on the quality standards of the accommodation.
In the event of any complaints regarding the services received, so that there is evidence of the problem complained of and so that it can be promptly remedied, the travelling client must immediately contact Easyelba. The Client may also submit a written complaint by registered letter to be sent to Easyelba no later than 10 working days from the end of the services indicated in the Travel Contract.
The sale of tourist packages/services this website concerns is governed by these General Conditions and by the provisions of the International Convention relating to Travel Contracts (C.C.V.) ratified and enforced by Law no. 1084 of 12/27/1977, as applicable, as well as by the Consumer Code referred to in Legislative Decree no. 206 of 06/09/2005 (articles 82-100), as amended. Pursuant to art. 85-86 of Decree-Law no. 206 of 06/09/2005, the travel agent that makes the booking of tourist services on behalf of a Client is obliged to sign the travel contract directly with the Client, which describes in detail all the services booked and unequivocally specifies that the Client has read, accepted and received a copy of the General Conditions shown on the Easyelba website. Failure or incomplete compilation and signing of the Travel Contract shall release Easyelba from any liability for non-fulfilment of the obligations imposed on the agency and the consumer. No responsibility may lie with Easyelba for damage and/or inconvenience caused by: strikes, suspensions or delays due to adverse weather conditions, natural disasters, public works, road accidents, lack of water, electricity, interruptions in communications and transport. These cases, or other similar ones, cannot be attributable to the organiser, or to the carriers, or to the service providers. Any additional costs incurred by the Client for these causes shall not be reimbursed nor shall any services that, for these reasons, cease or cannot be recovered. Furthermore, the organiser cannot be held responsible for any damage resulting from independent initiatives taken by the traveller during the trip. Baggage travels at the Client’s own risk and Easyelba shall not be liable for any theft, loss or damage.
11) ASSISTANCE OBLIGATION
The organiser is required to provide the traveller with the assistance measures imposed by the criterion of professional diligence, exclusively with reference to its obligations.
12) THIRD-PARTY LAIBILITY INSURANCE
To cover the risks arising to people from participation in travel or accommodation programs as well as to ensure the exact fulfilment of the obligations undertaken towards clients, Easyelba has entered into a Civil Liability policy for Travel Organisers and Intermediaries with the insurance company Allianz. Policy number 78302739, pursuant to art. 86 L.R.T. no.42 of 23/03/2000 and no. 14 of 17/01/2005.
13) GUARANTEE FUND
Art. 100 of Decree=Law no. 206/2005 provides for the establishment of a guarantee fund at the Ministry of Productive Activities which can be used by all travellers in the event of insolvency or bankruptcy of the travel agent or organiser. The methods of intervention of the fund are established by decree of the Ministry of Productive Activities (Art. 100 of Legislative Decree 206/2005).
The Court of Livorno shall have exclusive jurisdiction over any claims or disputes.
15) CONSENT TO THE PREOCESSING OF PERSONAL DATA
All personal data shall be processed in full compliance with the provisions of Decree-Law no. 196/2003 and used exclusively for the completion of the formalities relating to making reservations and for the shipment of our advertising material.
Clients have the right to modify, supplement and request the cancellation of the personal data they provide.
